A Efetivação dos Direitos Sociais Versus Democracia

O presente trabalho propõe uma reflexão crítica sobre
a possibilidade da efetivação dos direitos sociais pelo Poder Judiciário
sem minorar o valor substancial da Democracia. A busca pela efetividade
da Constituição permite ao Direito cumprir o seu papel transformador
da sociedade. Não obstante, tal busca deve ser norteada e respeitar os
limites constitucionais impostos, não podendo macular os princípios
democráticos, nem interferir indevidamente nos poderes políticos, bem
como no mérito de políticas sociais.
This research intends a critic reflexion about
the possibility of accomplishment of social rights by the Judiciary
without decreasing the substantial democracy worth. The search for
Constitution’s fulfillment allows the law to implement the changing
role in society. Nevertheless, such a search should be guided and respect
the constitutional limits imposed in order to avoid harming democratic
principles and also incorrectly interfere in the political powers, as well as
the merit of social policies
