O presente artigo investigou quais contornos o processo civil deve conter a fim de ser adequado ao tratamento de problemas estruturais ligados aos direitos humanos e efetivo para a função jurisdicional de atribuir significado concreto e aplicação aos valores públicos contidos na Constituição. Superando a teoria da autonomia do processo civil, arraigada aos valores dominantes no século XIX e à abstratização do homem difundidos nesta época, buscou-se repensar o conceito de jurisdição à luz da Constituição e propor um procedimento adequado ao caso concreto e, em especial, aos casos estruturais.
The central concern of this article was to investigate what contours the civil process must contain in order to be adequate for the treatment of structural problems linked to human rights and effective for the jurisdictional function of assigning concrete meaning and application to the public values contained in the Constitution. Overcoming the theory of autonomy in the civil process, rooted in the dominant values in the 19th century and the abstraction of man spread at this time, we sought to rethink the concept of jurisdiction in the light of the Constitution and to propose a procedure appropriate to the specific case and, in particular, structural cases.
