O artigo traz um resgate histórico dos povos escravizados,
excluídos socialmente após a abolição da escravatura, e analisa-os frente ao
instituto da cidadania dos estados democráticos a partir do século XX. Para
tanto, demonstra-se o processo de reconquista do estatuto de humano
desde a Lei Áurea de 1888 à Constituição Federal de 1988, destacandose o papel das supremas cortes na busca pela igualdade para todos,
independentemente de raça ou cor, e do debate quanto ao exercício das
liberdades positiva e negativa.
This article intends to make a historical rescue of the
slaves community, socially excluded after the abolition, and analyzes them in
front of the citizenship institute of democratic states from the 20th century
on. It aims to demonstrate the process of regaining human status since the
Áurea Law of 1888 to the Federal Constitution of 1988, highlighting the
role of the supreme courts in the search for equal conditions to everyone,
no matter their race or color, and the debate on the exercise of positive and
negative freedoms.
